Introduction
In this Privacy Policy (Policy), ‘us’ ‘we’ or ‘our’ means DRK Assets Pty Ltd trading as Nexus Psychology. Nexus Psychology offers practice support services to select psychologists, therapists and clinicians (Clinicians) who provide counselling services. One of the practice support services offered by us is an intake service (Intake Service) which involves matching specific individuals to Clinicians and booking them in for counselling services with a Clinician, either because an individual has asked us to be matched with a specific Clinician, or because the individual has indicated to us that they are seeking counselling services and want assistance being matched to a suitable Clinician. We additionally offer a reception and admin point of contact to facilitate administrative communications associated with your counselling appointments (Admin Service).
In this Policy, ‘you’ or ‘your’ ‘you’ or ‘your’ refers to an individual who has provided us with personal information for the purpose of the Intake Service, and for the purpose of arranging and communicating about appointments with an independent Clinician.
Our Policy sets outs out how we collect, use, store and disclose your personal information. Personal information includes information or an opinion about an individual that is reasonably identifiable. For example, this may include your name, age, address, contact details, Medicare details, billing information, general appointment information and other personal information relevant to your reasons for seeking counselling services.
By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Policy. We may change this Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you are aware of our current Policy.
This Policy complies with the privacy laws of Australia and assumes that the collection of personal information is from Australian citizens. If you reside in a country outside of Australia and provide us with your personal information, we make no representations or warranties that this Policy complies with the privacy laws and regulations of your country.
This Policy should be read by you in conjunction with our Website Terms and Conditions.
This Policy does not pertain to the collection, storage and handling of your information by a Clinician who provides you with Counselling Services, and who will issue you a separate set of terms that detail how it handles your personal information.
What personal information do we collect from you?
If you contact us either seeking Counselling Services from a Clinician, we may, as part of our Intake Service and/or Admin Service, collect the following types of personal information from you:
- name;
- mailing or street address;
- email address;
- telephone number and other contact details;
- age or date of birth;
- referral information (where relevant);
- details of the reasons you are seeking Counselling Services; and
- any other personal information that may be required in order to facilitate your dealings with us or with a Clinician who provides you with Counselling Services.
We may collect these types of personal information either directly from you, or from third parties with whom you have disclosed this information and authorised to contact us, such as your General Practitioner, a medical specialist, an allied health practitioner and/or your employer. We may collect this information when you or a referring third party:
- provide this information via our website; or
- communicate with us via phone or email or other written forms.
Why do we collect, use and disclose personal information of Clients?
We may collect, hold, use and disclose your personal information for the following purposes:
- to provide the Intake Service;
- to send you service, support and administrative messages, reminders, technical notices, updates, and information requested by you; and
- to comply with our legal obligations.
To whom do we disclose personal information?
We may disclose your personal information (in each case only to the extent that the personal information is required to be disclosed):
- to a specific Clinician who you have identified for the purpose of receiving counselling services;
- where you have not identified a specific Clinician, to a Clinician whom we identify as suitable to provide you with counselling services;
- to our employees or contractors (either in Australia or overseas) for the purpose of providing the Intake Service or for administration relating to your Counselling Services appointments and/or communications;
- to referring third parties;
- to anyone to whom our assets or businesses (or any part of them) are transferred; and/or
- to other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.
All personal information gathered during the provision of our services remains confidential except when:
- required by law (e.g., subpoenaed by a court);
- there is a reasonable belief that failure to disclose would place a client or another person at serious risk to life, health, or safety;
- you provide us with prior written consent for disclosure;
- disclosure to another professional or agency is directly related to the primary purpose for which the information was collected.
Overseas Disclosure
We may disclose personal information to third party software suppliers, cloud providers, or administrative contractors located outside of Australia. When this occurs, we take reasonable steps to ensure that information is handled in accordance with the principles and practices adopted under this Privacy Policy, and in a manner consistent with Australian privacy laws and principles.
By providing your personal information to us, you acknowledge that, in some circumstances, overseas suppliers may not be subject to, or may not always handle information in ways that are strictly compliant with Australian privacy laws.
Security
We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your personal information. However, we cannot guarantee the security of your personal information.
The measures we take for ensuring data security include, but are not limited to: encryption of digital records, the use of secure software platforms, software access protection via regularly changed unique passwords and multi-factor authentication, software permission restrictions based on role, and additional security protocols pertaining to transmission, storage and disposal of data.
In the event of unauthorised access, disclosure, or loss of personal information we will activate a data breach plan and take all reasonable steps to minimise any potential loss or compromise.

Accessing or correcting your personal information
You can access the personal information we hold about you by contacting us. Sometimes, we may not be able to provide you with access to all of your personal information and, where this is the case, we will tell you why. We may also need to verify your identity when you request your personal information.
If you think that any personal information we hold about you is inaccurate, please contact us and we will take reasonable steps to ensure that it is corrected.
Making a complaint
If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your personal information, you can contact us. Please include your name, email address and/or telephone number and clearly describe your complaint. We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time. If you think that we have failed to resolve the complaint satisfactorily, we will provide you with information about the further steps you can take.
