Terms of Service

Introduction

In these Terms (Terms), ‘us‘ ‘we‘ or ‘our‘ means DRK Assets Pty Ltd trading as Nexus Psychology. Nexus Psychology’s offers practice support services to select clinicians (Clinicians) who provide counselling services. The primary Service we provide individuals is the intake service (Intake Service), which involves matching and booking individuals with Clinicians for counselling services, either because an individual has asked us to be matched with a specific Clinician, or because the individual has indicated to us that they are seeking counselling services and want assistance being matched to a suitable Clinician. In these Terms, ‘you’ or ‘your’ refers to an individual who has provided us with personal information for the purpose of the Intake Service.

These Terms should be read by you in conjunction with our Privacy Policy.

What services do we offer you?

The primary service that we offer you is the Intake Service.

We additionally offer a reception and admin point of contact to facilitate administrative communications associated with your counselling appointments (Admin Service).

While undertaking our Intake Service and Admin Service, we handle your information in accordance with our Privacy Policy.

Nexus Psychology does not provide you with counselling services. Those services are provided by the Clinician you are matched with under the terms of a separate legal document between you and the Clinician. For the avoidance of doubt, you are never considered a ‘patient’ or ‘client’ of Nexus Psychology, and Nexus Psychology does not have a fiduciary duty of care towards you in the manner that a healthcare provider has towards a patient.

How does the Intake Service work?

The Intake Service works in one of two ways:

1. Direct Match: you contact us and request an appointment with a specific Clinician, and we facilitate a booking between you and that Clinician; OR
2. General Match: you contact us and request that we match you with a Clinician deemed suitable based on your specific needs or circumstances.

Before we formally match with you a Clinician, we will provide you with details of that Clinician’s experience. A detailed description of a Clinician’s experience and specialties can also be found on the Nexus Psychology website.

The decision to proceed with a Clinician is yours and yours alone. You are under no obligation whatsoever to proceed with a Clinician we match you with. You may request at any time that we provide you with the details of other Clinicians; or to be matched with a different Clinician.

We do not warrant that the Clinician matched to you will be appropriate for your individual counselling needs, and you may request a rematch with a different Clinician at any time if you deem a match to be unsuitable for any reason.

Legal relationship in respect of counselling services

Once you proceed with a Clinician, you will be asked to provide informed consent by that Clinician (Counselling Service Terms) for terms that govern the legal relationship between the Clinician as the provider of the counselling services and you as the recipient of counselling services. Nexus Psychology is not a party to the Counselling Service Terms and has no rights and no responsibilities thereunder.

Any notes taken by the Clinician during your sessions are the property of the Clinician, and Nexus Psychology has no proprietary interest in any of those notes.

To the extent that you are unhappy with any of counselling services provided to you, you may direct any concerns or complaints directly to the Clinician.

Liability

Nexus Psychology has no liability to you whatsoever in respect of the provision of counselling services by the Clinician to you.  You hereby release and forever discharge Nexus Psychology from any claims you may have in respect of the provision of the counselling services provided by a Clinician to you.

General

By proceeding to have counselling services from a Clinician matched to you (either via a Direct Match or a General Match) you will be deemed to have accepted these Terms and the terms of our Privacy Policy.

These Terms and all related matters are governed by the laws of Victoria.

Nexus Psychology may amend or vary these Terms from time to time without notice to you provided that such a variation does not materially prejudice your rights.
